Privacy Policy

Flygpengardirekt handles your personal data in compliance with the General Data Protection Regulation (GDPR) and EU Regulation 216/679, which govern the rules for processing personal data.

Which personal data is handled?

We collect only the data necessary to manage and assess your legal case. This data collection is strictly limited to the essential information required for each specific stage of your case.

You are only required to provide the data necessary for the current step of your case. For example, you do not need to submit your personal ID number when opening a case. However, if your case proceeds to court, the court in your jurisdiction may require your personal ID for verification purposes.

At the initial case opening stage, we encourage you to provide your address, bank information, and social security number/personal ID to expedite the process and ensure swift case management.

When you open a case with Flygpengardirekt, you will be asked to provide personal information in Category 1 to begin the assessment of your case.

Category 1

  • Name
  • Telephone/mobile number and/or email address
  • Booking number

Your name and booking number will be shared with the relevant airline, as they are the recipient of your legal claim. We will use your contact information to update you on your case or request additional information.

During the case opening process, you may also provide personal information in Category 2:

Category 2

  • Address
  • Bank account number / IBAN number
  • Social security number / Personal ID
  • Photo ID

Category 2 information may become necessary for the assessment of your case at a later stage. You will need to provide this information if we determine it is required for your case, such as when proceeding to court or when we need to transfer compensation to you.

In some cases, you may be asked to send a photo ID, as some airlines require ID verification to process claims. You will receive guidance on blurring any irrelevant personal data before submission. If not adequately blurred, we will ensure further blurring before sharing with the airline.

We process your personal information based on the agreement and contract we have with you or as a result of our legal obligations.

Purpose of collecting your personal information

The primary purpose of collecting your personal information is to secure compensation or a refund from the airline in accordance with EU Regulation 261/2004. If you breach your contract with Flygpengardirekt, your personal information may be used in the process of pursuing a claim against you.

Your bank information will only be used to transfer compensation or refunds to you. In some cases, the airline may wish to pay you directly, requiring us to share your bank information with the airline. Flygpengardirekt, our business partners, or airlines do not have access to withdraw money from your bank account.

How long do we keep your data?

Flygpengardirekt retains your personal information for as long as necessary. The duration depends on various factors, including the type of personal information and the outcome of your case. Category 2 information is erased sooner than Category 1 information.

For example, if there has been a bank transaction related to your case, we are legally required to retain your personal data for five years, as per the Accounting Act in Sweden. If your case is determined to be ineligible for a payout early in the process, we will close your case and erase your personal information shortly thereafter.

You have the right to know how long we keep and protect your personal information, as detailed further below.

Sharing data with third parties

Your personal information may be shared with airlines, airline representatives, our business partners in other EU or EEA countries, and state-owned authorities, such as courts. We share information only as necessary to legally assess your right to compensation.

Your data is shared with Flygpengardirekt’s parent company, Flightright GmbH, which enters it into our internal case handling system, CMA. This system is used to manage your claim against the airline.

We require all our business partners who receive personal information to support your case to comply with data protection laws. Flygpengardirekt has data protection agreements with our partners to ensure they handle your personal data according to the regulations.

Sharing data outside the EU

Sharing personal information outside the EU can pose certain risks, as third countries are not covered by the GDPR. If your claim is directed to a non-European or non-EEA based airline, some of your personal information will need to be shared with the airline.

These airlines are not Flygpengardirekt’s business partners, so we cannot enter agreements on how they handle your personal data. We only share the necessary data to obtain compensation or a refund for you.

Your rights regarding your personal data

Your personal information is handled transparently, meaning you have the right to request insight into how we store and process your data at any time. If the information we have is incorrect or misleading, you have the right to correct it. You also have the right to have all your personal information erased, provided you meet the requirements of the GDPR, Article 17.

Security

Flygpengardirekt has implemented appropriate technical and organizational security measures to ensure your personal information is handled correctly and securely. We have taken all possible precautions to prevent your data from being erased, disclosed, lost, devalued, or accessed by unauthorized personnel. Furthermore, measures are in place to ensure your personal data is never accidentally or unlawfully processed.

Our employees are thoroughly trained in handling personal information according to our guidelines. If you believe Flygpengardirekt has mishandled your data, you have the right to lodge a complaint with the Data Inspectorate in Sweden.
